Welcome to RentMark, a PropTech platform based in Hong Kong, providing real estate professionals with AI-driven tools, lead generation, and data analytics. By accessing or using our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please refrain from using our platform.

1. Acceptance of Terms

These Terms govern your use of RentMark’s services, including lead finding, instant notifications, 500+ daily buyer/seller leads, team-sharing functions, AI-driven insights, chatbots, customer reports, dashboards, and API access. We reserve the right to update these Terms at any time, with notice provided via email or our website. Continued use of our services constitutes acceptance of the updated Terms.

2. Eligibility

You must be a real estate professional or authorized representative to use our services. By registering, you confirm that you are at least 18 years old and have the legal capacity to enter into this agreement. You may not use our services if you are barred from doing so under applicable law.

3. Services and Uptime

RentMark provides tools to empower agents with real-time data and AI insights. We guarantee a 99% uptime for our services, except during scheduled maintenance, upgrades, or unforeseen events (e.g., force majeure, internet outages). Downtime beyond this guarantee may result in service credits at our discretion, subject to a formal request within 30 days of the incident.

4. Data Security and Compliance

We prioritize your data security through the following measures:

  • SSL Secured: All data transmissions are encrypted using Secure Socket Layer (SSL) protocols.
  • ISO Data Security: We adhere to ISO standards for data protection to safeguard your information.
  • GDPR Compliance: For users in the EU or where applicable, we comply with the General Data Protection Regulation (GDPR), ensuring lawful and transparent data processing. You may request data access, correction, or deletion by contacting support@rentmarkglobal.com.

We also comply with Hong Kong’s Personal Data (Privacy) Ordinance (PDPO) and will adhere to other applicable data protection laws as we expand globally.

5. Privacy Policy

Your use of RentMark is also governed by our Privacy Policy, available on our website. The Privacy Policy details how we collect, use, and protect your personal data, including leads and client information. By using our services, you consent to our data practices as outlined therein.

6. User Responsibilities

You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • Ensuring all activities under your account comply with these Terms.
  • Not misusing our services, including unauthorized access, data scraping, or sharing confidential leads with third parties.
  • Providing accurate information during registration and use.

Violation of these responsibilities may result in account suspension or termination.

7. Intellectual Property

All content, including but not limited to AI algorithms, dashboards, reports, and software, is the exclusive property of RentMark or its licensors. You are granted a non-exclusive, non-transferable license to use our services for professional purposes only. You may not reproduce, modify, or distribute our content without prior written consent.

8. Payment and Subscription

RentMark offers a 14-day free trial with full access, no credit card required. Post-trial, subscription fees apply as outlined on our pricing page. All payments are non-refundable, except where required by law. We reserve the right to adjust fees with 30 days’ notice via email or our website. Failure to pay may result in service suspension.

9. Third-Party Services

Our platform may integrate with third-party services (e.g., APIs, payment processors). RentMark is not responsible for the availability, accuracy, or security of third-party services. Your use of such services is at your own risk and subject to their respective terms.

10. Termination

We may suspend or terminate your account for violations of these Terms, with notice provided via email. You may cancel your subscription at any time, with access ending at the billing cycle’s conclusion. Upon termination, your data may be retained for 30 days before deletion, subject to legal obligations.

11. Disclaimer of Warranties

RentMark’s services are provided "as is" and "as available." We disclaim all warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that our services will be uninterrupted, error-free, or free from viruses.

12. Limitation of Liability

RentMark, its affiliates, and licensors shall not be liable for indirect, incidental, special, or consequential damages arising from your use of our services, including loss of profits, data, or business opportunities. Our total liability is limited to the amount paid by you in the preceding 12 months.

13. Indemnification

You agree to indemnify and hold RentMark harmless from any claims, damages, or losses arising from your misuse of our services, violation of these Terms, or infringement of third-party rights, including reasonable legal fees.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Hong Kong. Any disputes shall be resolved in the courts of Hong Kong, unless otherwise required by applicable law for international users. You agree to attempt resolution through mediation before pursuing legal action, with mediation costs shared equally.
